Update on Hours of Service Rules

The update is:  there is no update.  Yes, the deadline for FMCSA to respond to the court is this Friday, but they have been completely silent.  I guess this means they will not offer any sort of rebuttal or answer to the court, which means on Friday there is no more 11 hour rule, or 34 hour reset provision.  I imagine the FMCSA will come out next Monday with revised hours rules incorporating the court’s mandates.  But that’s just me guessing.  Stay tuned, nothing is certain yet.

    I found a few websites that show that the ATA filed a motion against the 7/24/07 ruling on 9/6/07. Under the provisions, the court must rule on the motion before any change to the HOS can take place. The ATA asked for an 8 month stay to allow for companies to implement the new HOS. The OOIDA also filed on the 6th – they want the court to rehear the sleeper berth provisions. They would like to see the 14 hr clock so a driver can take a short nap/rest. I am glad somone is pushing that angle!

    Kari: You are correct, ATA filed a petition asking for a stay. I’m not a lawyer (although I play one on TV), so I don’t really know what it means. Until FMCSA issues the rules, you continue to use the old rules, regardless of what the court says. Originally, I didn’t blame FMCSA for this mess, but I’m starting to change my opinion. Where have they been since all this has gone on? Silence, leaving us all to twist in the wind.
